 MAKEBHM BUILDING RULES & POLICIES

 

Below are the MAKEbhm Building Rules & Policies. All members and guests will abide by these rules and policies during all classes, membership activity, and license agreement arrangements. This document can also be downloaded as a PDF by clicking here.

 

 
  1. Building Policies

    a) Member acknowledges and agrees to the following Building Rules & Policies for all MAKEbhm members and their guests. “We” and “our” refer to MAKEbhm, and “you” and “your” refer to members that are subject to the Building Rules & Policies, including Member.

    1. MAKEbhm strives to provide a safe, productive and fun work environment for its Members and Guests. In light of this mission, we ask you to obey the following policies and procedures for working in our facility. Failure to obey these policies and procedures can make our facilities dangerous or unwelcoming to others, and such actions on your part may result in your license being terminated without notice. Please take them seriously. We reserve the right to change these policies and procedures as needed and with sufficient notice to members.

    2. Individual Safety:

      Obey all posted signs and literature pertaining to safe use of our facilities. These include but are not limited to signs regarding appropriate shop clothing and protective gear, techniques for safe equipment use, material-specific precautions for equipment, and machine tool lockouts. Do not use equipment you are not comfortable with or trained to use. Our strong preference is that you not operate heavy machinery after staffed hours without a partner in the facility; operate it individually at your own risk. Ask for help if uncertain.

    3. Shared Safety:

      In a shared and open facility like ours, it is possible for less-experienced members to operate equipment dangerously without knowing it. Please stay on the lookout for unsafe behavior, and approach and offer feedback to fellow members if you believe they are working unsafely. Please notify staff immediately if you believe any piece of equipment or infrastructure to be unsafe. Hazardous materials are strictly prohibited. Members are fully responsible for understanding, mitigating, and avoiding all hazards of the material or medium with which they are using, including any additional cleaning required to maintain a safe working environment. If you are unsure if a material is hazardous, consult with MAKEbhm staff.

    4. Building Security

      Members and guests will not compromise the building security or the security of the spaces therein and will ensure that all reasonable measures are taken to safeguarded the Building, its occupants and the occupants possessions. At no time should security locks be bypassed or left in an open position and external doors should never be propped open whilst unattended. Access codes are unique to each Member and should not be shared, even with other Members. Members will not compromise the Building’s protection from fire, flood, gas, electricity or weather.

    5. Common Area Cleanliness

      It is expected that Members clean up after themselves in all common areas. Members using the kitchen facility are expected to clean up promptly, including dishware, sink, countertop, and dining table. Members using the restroom are expected to notify staff of any cleaning or restocking needs promptly. Members who consistently leave common areas unclean are subject to cleaning fees.

    6. Quiet Enjoyment

      It is expected that Members will observe the quiet enjoyment and normal use of the Building at all times and not damage or deface the Building or its fixtures, fittings, decor and furnishings.

    7. Open Environment

      This is an open office/space shared by many different people and organizations. Anything that is said should be expected to be heard by others.

    8. Respectful Behavior:

      In both in-person and electronic interactions, behave respectfully, courteously, and professionally to your fellow members. No discrimination, harassment, or hate speech shall be tolerated. MAKEbhm expressly prohibits any form of workplace harassment based on race, color, religion, gender, sexual orientation, gender identity or expression, national origin, age, genetic information, disability, or veteran status. Improper interference with the ability of MAKEbhm’s Members or guests to perform their job duties may result in discipline up to and including loss of membership, termination of license, and discharge from the facility.

    9. Courtesy of Individual Spaces:

      Do not enter any individual workspaces that are not yours without explicit permission. Do not use materials or tools belonging to other people without permission. Do not steal. If you are licensing space from us, please keep your individual space relatively orderly.

    10. Courtesy of Shared Spaces:

      Keep noise levels to a respectful minimum for the comfort and enjoyment of those in the immediate area. No loud music, tool use or other noise will be permitted in the open rental areas without the explicit permission of the members around you. No fumes or flames are permitted in unventilated areas. Restore the shared spaces and studios to be as clean as or cleaner than when you found them. Please respect and do not interrupt any official MAKEbhm activities or classes in the shared spaces.

    11. Presence:

      Inactivity and lack of physical presence at our community facility can be detrimental to our mission and prevent others from using the space. Please inform us of any extended absences or extenuating circumstances that might prevent you from attending. Otherwise, we expect Members to make regular use of our facilities.

    12. Guests:

      Non-Member guests are permitted in the Building so long as they do not use MAKEbhm equipment or shared areas or interfere with other Members. Any guest who is using any kind of equipment in MAKEbhm, including Member-owned equipment, must sign a liability waiver. Guests and their actions are the sole responsibility of the host Member. Any recurring guest must sign a liability waiver. MAKEbhm reserves the right to require any guest in the building to sign a liability waiver.

    13. Tolerance of Feedback:

      Please be open to constructive feedback from fellow Members, especially as it pertains to safe use of our equipment and respectful communication or behavior.


  2. Communications

    a) Communication Platforms

    MAKEbhm will provide Member access to digital communication platforms, including but not limited to calendar applications, internal communications applications, and direct digital contact information for MAKEbhm staff, for various purposes during the term of this Agreement. Member acknowledges and agrees that MAKEbhm will communicate important information through these digital platforms, and that all information disseminated from MAKEbhm through these platforms will be considered received by Member in writing.

    b) Communication Restrictions

    Member will not use communications platforms provided by MAKEbhm for purposes other than explicitly outlined by MAKEbhm within each platform. Member will not use communications platforms to access or distribute any unlawful material. All communication on digital platforms will conform to the standards of respectful behavior detailed in Section 1(a)(viii). Any violation of these standards of respectful behavior, in person or on the digital platforms provided by MAKEbhm, will constitute loss of Membership, termination of license, and discharge from the facility.

  3. Indemnification & Liability

    a) Indemnification

    Member releases, and hereby agrees to indemnify, defend and save harmless MAKEbhm, LLC & MAKE Holdings, LLC, their subsidiaries (whether or not wholly-owned), affiliates, divisions, and their past, present and future officers, agents, shareholders, members, representatives, employees, successors, and assigns, jointly and individually, from and against all claims, liabilities, losses, damages, costs, expenses, judgements, fines and penalties based upon or arising out of your negligent actions, errors and omissions, willful misconduct and fraud in connection with the participation in or use of the Services. Member further agrees in the event that Member brings a claim or lawsuit in violation of this agreement, Member shall be liable for any attorneys’ fees and costs incurred by MAKEbhm, LLC or its respective officers and agents in connection with the defense of such claim or lawsuit.

  4. Photo & Media Release

    a) Media Release

    Member consents that MAKEbhm has full and unrestricted publishing and use rights for any photographs, digital or print, taken on the MAKEbhm property by MAKEbhm employees in which Member’s image or any of Members materials or art, either brought in or created at MAKEbhm, appears. Member releases, discharges, and agrees to hold harmless MAKEbhm from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.

    b) Publication & Listing

    Member consents that MAKEbhm will list, display, or otherwise publish Member’s name or business name on MAKEbhm digital and print materials, unless Member explicitly requests otherwise at the execution of this Agreement. Member understands that requests during the term of this Agreement to cease listing, displaying, or otherwise publishing Member’s name or business name will be honored by MAKEbhm, but previous publishing instances will not be altered or removed.
